Nintendo's next-gen console, the Nintendo Switch 2, is flying off shelves worldwide. However, a wave of misleading and "malicious listings" has emerged on major Japanese resale platforms, sparking strong consumer backlash. Some sellers claim to be offering a Switch 2, but buyers are reportedly receiving only an empty box or even just a photo.

According to investigations by Japanese media, some listings feature console photos but explicitly state in the description, "This item is an empty Nintendo Switch 2 box." Other sellers even specify, "A picture of the Switch 2 will be delivered." Despite prices often exceeding 50,000 yen, consumers might only receive an empty item or an image.
While Nintendo has ramped up efforts to combat scalping and partnered with three auction platforms to block fraudulent listings, it remains challenging to prevent some sellers from exploiting "description traps" to evade legal responsibility. According to lawyer Kawanishi from a legal firm, if a product description clearly states that only a photo or an empty box is being sold, it may not constitute fraud. However, consumers who fail to read the description carefully might mistakenly believe they are purchasing the actual console.

Kawanishi also warned that if a product description is overly vague—for instance, merely stating "items other than the photo are not included" without clearly specifying the actual content of the "photo"—it could potentially be considered fraudulent.
Many netizens have already taken to social media platforms to issue warnings, urging those looking to buy a Switch 2 to stick to official channels or reputable sellers to avoid falling into the trap of "paying a high price for an empty box."
